How to Properly Use Flavor Dynamics’ Registered Trademarked Flavors: A Licensee’s Guide
Proper Registered Trademark usage protects the value behind every licensed flavor, from Jamaican Me Crazy® Coffee Flavor, Jamaica Me Crazy® Coffee Flavor and Jazzy Java® Coffee Flavor to Maple Bacon® Coffee Flavor, Mole Cannoli® Coffee Flavor, Frosty's Favorite® Coffee Flavor, Jamaican Me Nuts® Coffee Flavor, and Mele Kalikimocha® Coffee Flavor. This guide walks licensees through the essentials of Registered Trademark licensing, from packaging approval to what makes some of these among the most popular flavored coffee options on the market today.
Key Insights
- Registered Trademark protection depends on correct use. Casual or inconsistent use can weaken the protection. Our strength in the industry can help protect your product assets.
- Packaging needs our approval before launch, so building that approval window into your production timeline avoids the most common compliance issue: printing before sign-off.
- A Registered Trademark license and a logo license are two different things. Getting rights to use a licensed flavor name doesn’t automatically include rights to use Flavor Dynamics’ corporate logo.
- Licensed flavor can’t be blended with outside flavor systems. Combining a licensed flavor with another supplier’s flavor system changes its identity, even when the intent is simply to adjust the taste profile.
- Know what happens when your license ends. Understanding terms, renewal conditions, and a sell-off period for inventory prevents surprises at the end of the license term.

What You’re Getting When You License a Flavor
If you license a Registered Trademarked flavor from Flavor Dynamics, you’re getting more than a taste profile. You’re getting a name your customers may already recognize, along with everything that comes with it: proven consumer appeal, built-in shelf differentiation, and the protection of an established Registered Trademark.
That’s true whether it’s Jamaican Me Crazy® Coffee Flavor, Jamaica Me Crazy® Coffee Flavor, Jazzy Java® Coffee Flavor, Mole Cannoli® Coffee Flavor, Maple Bacon® Coffee Flavor, Frosty’s Favorite® Coffee Flavor, Jamaican Me Nuts® Coffee Flavor, or Mele Kalikimocha® Coffee Flavor, several of which rank among the most popular flavored coffee options on the market. Each of these flavor names is a Registered Trademark. In such a case, your relationship with us runs through a formal Registered Trademark license agreement, and you get a legally protected brand asset.
Why Registered Trademark Protection Depends on How You Use It
First, each Registered Trademark flavor is a proprietary blend that meets the legal definition of the Registered Trademark we registered. A name, symbol, or design identifies and distinguishes a product’s source. That protection is what makes the name valuable to your product in the first place. It tells your customers exactly what they’re getting. That’s the purpose of a Registered Trademark: to identify the source and prevent consumer confusion. It keeps competitors from using the same name on something else.
Registered Trademarks fall into different types, and understanding the types of Trademarks helps explain why some names hold up better than others. Some are word marks, like a flavor name. Others are design marks, like a logo or label graphic. Descriptive Trademarks describe a product feature directly. Word marks, design marks, and descriptive marks are all examples of Trademark categories you’ll run into in a licensing relationship like ours. The most popular flavored coffees, like Jamaican Me Crazy® Coffee Flavor, are stronger and easier to protect. Each of these flavor names is a Registered Trademark example of that stronger, more distinctive category. How you use it is one of the key characteristics that gives a name its legal strength. Famous Trademarks like Kleenex and Nike’s swoosh show what’s at stake. Without careful, consistent use, even a well-known mark can lose some of its legal protection over time.
But a Registered Trademark’s staying power also depends on consistent, correct use day-to-day. Casual or incorrect use can weaken the mark, even when it’s unintentional. It can also create consumer confusion. And it can put both your license and our underlying intellectual property at risk. Forty years of consistent compliance with Registered Trademark rules backs our strength in this industry, and we will work alongside you to protect your Registered Trademarked products.
Everything below exists to help you avoid that outcome.
How to Properly Display the Registered Trademark on Packaging
Using our Registered Trademark exactly as the Trademark License Agreement and Usage Guidelines specifies, gives your product the protection it deserves, and our industry’s continued strength and presence to back that protection. Correct Registered Trademark usage covers capitalization, spelling, Registered Trademark design, and any required ® symbol.
Don’t alter, abbreviate, combine, or incorporate the Registered Trademark into a new logo. And don’t use it in a way that could suggest you own the Registered Trademark.
Attribution Language: What You Can and Can’t Say
I have found that companies don’t state that their products contain or are made with a licensed flavor. That gets them into trouble. So, make sure the statement is accurate and complies with your License Agreement and applicable labeling laws. Approved language is:
- “[Jamaican Me Crazy® Coffee Flavor] is licensed by Flavor Dynamics”
Where appropriate, include an attribution statement on your packaging. For example: “[Jamaican Me Crazy® Coffee Flavor] is a Registered Trademark of Flavor Dynamics,” or other required language.
Avoid any language that implies that we manufacture, endorse, sponsor, or guarantee your finished product. Support any nutritional or functional claim about the Registered Trademarked flavor on your label, independent of the Registered Trademark itself.
Getting Packaging Approved Before Launch
If we’ve assigned a representative to you, submit packaging and marketing materials that display the Registered Trademark for approval through them before commercial launch. Otherwise, please submit them through our customer care team. Using the Registered Trademark directly affects intellectual property rights and brand reputation, so this step isn’t optional.
The approval review checks compliance with the License Agreement, the Registered Trademark guidelines, and quality or labeling requirements. It isn’t a broader creative review. After we approve a particular packaging format, future substantially identical versions generally don’t need a new approval. I know you’re working against a time-to-market clock, so we designed the review to move quickly.
Registered Trademark Use vs. Flavor Dynamics’ Corporate Logo
Also, what I would like to emphasize is that a license to use a Registered Trademark doesn’t automatically include a license to use our corporate logo. The flavor name is a word mark while the logo is a completely separate design. Registered Trademarks and logos are still separate intellectual property assets, even when they appear together on packaging. Your negotiated License Agreement only includes logo use if it specifically says so. Check your Agreement before assuming the logo comes with the Registered Trademark.
Combining a Licensed Flavor with Other Flavors
Questions about mixing flavors comes up often in Trademarked licensing, so it is worth addressing directly. As a general rule, you cannot mix a licensed flavor with a different company’s flavor system. Doing so can alter the identity, quality, or performance of the licensed flavor. In Registered Trademark licensing, few rules matter more than the ones governing flavor combinations. The Agreement prohibits it.
Quality Testing and Compliance Checks
We test products bearing our Registered Trademark to confirm compliance with your Registered Trademark license agreement and quality standards. Testing may cover the presence and concentration of the licensed flavor, quality and consistency, and compliance with agreed labeling requirements.
Your License Agreement sets reasonable timeframes for sampling, testing, and confidentiality. We structure our testing rights so they don’t interfere with your normal business operations.
License Term, Renewal, and What Happens If It Ends
I receive many questions about the exclusivity of Registered Trademark licensed flavors. We generally reserve exclusivity for licensees providing significant minimum purchases, marketing commitments, or other considerations that justify it.
A typical agreement runs for an initial term. It then renews for one or more periods if we both meet the agreement’s requirements. The agreement also addresses what happens if the Registered Trademark expires, if we abandon it, or if it becomes subject to a significant legal challenge. It also covers what happens if either party terminates for breach. After termination or expiration, you generally need to stop using the Registered Trademark. The exception is any negotiated sell-off period, during which you can still sell existing finished inventory.
Common Registered Trademark Misuse We See, and How to Avoid It
Reviewing licensee packaging and marketing materials is a regular part of our role. The same handful of issues come up far more often than anything else. None of them require a legal background to avoid. Just do a quick check before something goes to print or goes live.
- Packaging goes to print before approval. This is the most common issue I’ve seen by far. You can prevent it easily by building the review time into your production schedule. Don’t treat that window as a formality you tack on at the end.
- Licensees fold the Registered Trademark into a new logo. They often redesign a mark’s typography to match their own branding without realizing that alters the Registered Trademark itself. The name has to appear as licensed, not as a redesigned element of your logo.
- Wording that implies we made or endorse the finished product. Phrases like “Flavor Dynamics owns [product]” or “certified by Flavor Dynamics” go further than the license allows. Stick to “made with” or “contains” language.
- A licensee blends a licensed flavor with an outside supplier’s flavor to hit a specific taste target. This changes the identity of the licensed ingredient, and the Agreement doesn’t permit it. That’s true even when the intent is just to fine-tune a profile.
- Licensees assume the Registered Trademark license automatically includes our corporate logo. It usually doesn’t. Confirm what your specific agreement covers rather than assuming.
Frequently Asked Questions about our Registered Trademarks
Can I put a licensed flavor name into my own logo design?
No. A mark like Jamaican Me Crazy® Coffee Flavor has to appear exactly as licensed. Folding it into your own logo or redesigning its typography alters the Registered Trademark itself, and your license does not permit that. It would be like having a company you’ve partnered with change the typeface on your logo to match theirs. It’s your logo.
Can I Trademark my unique product after using Registered Trademarked flavors as ingredients?
Yes, and you will still need to use Registered Trademarks on your packaging the way your licensing agreement specifies. Rules falling under “white labeling” regulations may apply, depending on the circumstance. Don’t incorporate the Registered flavor name or our logo into your own Trademark or branding. Just contact us and we’ll work through it with you.
Do I need approval before my packaging goes to print?
Yes. Any packaging or marketing materials that display the Registered Trademark needs approval before commercial launch. Once we approve a format, substantially identical future versions generally don’t need re-approval, so build the review window into your production timeline rather than treating it as a last step.
Can I blend a licensed flavor with another supplier’s flavor system?
No. Mixing a licensed flavor with an outside company’s flavor system can change the identity, quality, or performance of the licensed flavor, and the Agreement prohibits it, even if the goal is simply fine-tuning a taste profile.
What can my packaging say about the licensed flavor?
You can generally state that your product is “made with” the licensed flavor, as long as the claim is accurate and follows your License Agreement and labeling laws. Avoid language suggesting that we manufacture, endorse, or guarantee your finished product.
What happens to my Registered Trademark rights if my license ends?
You generally must stop using the Registered Trademark after the license expires or terminates, aside from any negotiated sell-off period for existing inventory. Your original agreement outlines renewal terms and any minimum purchase or royalty thresholds.
How long will it take for Flavor Dynamics to review and approve my packaging?
We designed our approval process with speed in mind, using priority emails to expedite your review. That said, if your submission involves additional discussion about the mark, or compliance questions, the review may take longer than a straightforward trademark approval. Build in about as much time as a comparable approval would take at your own organization, and factor that into your launch schedule.
Does My Product Still Have Registered Trademark Protection if I Accidentally Use the Registered Trademark Differently than the Agreement Specifies?
Flavor Dynamics will walk you through any changes to be made so you will be in compliance.
What if I discover a competitor using the Registered Trademark?
Flavor Dynamics will make every effort to support your claim of infringement by a competitor. However, legal protection in a court or in arbitration hearings may depend on how closely you adhere to the Licensing Agreement. You are licensing the use of our Registered Trademark, and your compliance with the Agreement increases your protection. Rest assured, our 40 years of experience in this industry supports your efforts.
